Terms of Service

1. Parties

These Terms of Service ("TOS") govern your access to and use of the software-as-a-service platform (the "Service") operated by Scrayos UG (haftungsbeschränkt). The company address and registration details are published in our legal imprint / Impressum. By registering for or using the Service you accept these TOS.

2. Service Overview

The Service allows registered users to connect supported social media accounts (currently: YouTube, Instagram, Facebook, TikTok) via OAuth, upload images or videos (or screenshots from videos), provide optional contextual information, and receive AI-generated captions, hashtags and post suggestions. Users may edit suggestions manually or request additional AI edits. The Service can also publish content to connected social platforms on the user's behalf.

3. Registration and Account Security

  • You must provide accurate registration information and maintain account credentials securely.
  • You are responsible for activity under your account and for safeguarding OAuth connections to third-party platforms.
  • You must be legally entitled to enter these TOS (no restriction by age or capacity); minimum age is 16 unless local law requires otherwise.

4. Acceptable Use & Content

When using the Service you must comply with applicable laws and platform policies. You must not upload or publish content that infringes third-party rights, is unlawful, defamatory, pornographic, hateful, or otherwise prohibited. You remain solely responsible for your User Content and for ensuring it complies with the terms of any connected social platform.

5. License and Rights

By uploading content you grant Scrayos UG a limited, non-exclusive, worldwide, royalty-free license to host, process, modify, reproduce and transmit your content solely to provide the Service (including sending data to AI providers and publishing to connected platforms). You retain ownership of your User Content.

6. Third‑Party Integrations

The Service integrates with third-party platforms and processors (OAuth providers, AI provider(s), hosting, Matomo for analytics, Sentry for error-tracking). You must comply with third-party terms. Scrayos UG is not liable for actions taken by third parties (e.g., removals, account sanctions) or for changes in third-party APIs or policies.

7. AI Processing

Uploaded media, screenshots and optional textual context are transmitted to an AI provider (e.g., OpenAI) to generate captions, hashtags and suggestions. AI output is provided "as‑is" and may be imperfect. You are responsible for final edits and compliance of published content.

8. Monitoring, Analytics & Error Tracking

We use Matomo for analytics and Sentry for error tracking. For details about the data collected and legal basis, see our Privacy Policy.

9. Fees & Payment

If you subscribe to paid plans, those fees, billing cycles and refund rules are provided in the subscription interface and billing terms. Scrayos UG may change pricing or feature sets with notice.

10. Termination

Either party may terminate the agreement. You may delete your account at any time. Scrayos UG may suspend or terminate accounts for violation of these TOS or applicable law. Upon termination access to the Service will cease and data will be handled per the Privacy Policy.

11. Warranty Disclaimer

The Service is provided "as‑is" and "as‑available". To the extent permitted under applicable law, Scrayos UG makes no warranties and disclaims all implied warranties, including merchantability or fitness for a particular purpose.

12. Limitation of Liability

To the extent permitted by law, Scrayos UG's liability is limited to intent and gross negligence. Liability for simple negligence is limited to foreseeable damages typical for this type of contract. Liability for personal injury or mandatory statutory liability (e.g., Product Liability Act) remains unaffected.

13. Changes

We may change the Service and these TOS. Material changes will be notified (e.g., email or in-app). Continued use after notice constitutes acceptance.

14. Governing Law & Jurisdiction

These TOS are governed by German law. To the extent legally permissible, the exclusive place of jurisdiction is the competent court in Bonn.
